First Steps
  • Engage us as your Solicitors.
  • We can help you complete a formal Application to purchase your house. Timing can be important. The date of lodgement may affect the amount of discount you receive.
  • The Council will arrange for your house to be valued.
  • The Council issue a formal Offer to Sell. Consult us as soon as you receive the Offer to Sell. There are strict time limits for acceptance. 
Dealing with the Offer
  • We will discuss the terms of the offer with you in detail.  We will check the discount with you, deal with any queries and if appropriate, ask the Council to amend any of the contract terms.
  • We can help you arrange finance. .
  • We recommend you obtain an independent valuation. We can organise this.
  • If you are unable to obtain a mortgage and require a loan, you may be able to obtain a loan from the Local Authority.  We can help you complete the application.
  • If you are unable to obtain a loan, even from the Local Authority we can, on your behalf, apply to the Council for a "fixed price option".
  • If you wish to proceed we will lodge  the formal acceptance on your behalf. 
After the Offer is Accepted
  • The Council will send you and your neighbours a proposed title plan. Let us know when you receive this. If it is correct progress can be made by us more quickly when we receive the title documentation we require from the Council

    If it is wrong or if you have any queries, we can discuss these with you at the earliest possible opportunity
  • Shortly before settlement we receive from the Council the draft title in your favour along with some other title documentation we require to check.

    We will let you know when we receive these items.

  • Assuming the title is in order, we can then finalise with the Council a settlement date.

  • We then obtain up-to-date searches and prepare mortgage documentation.

  • If a mortgage is being obtained, it will be necessary to report to the lender that the title is in order, prepare the loan papers and have you sign them.

  • Prior to settlement we will prepare our own account. We will obtain from you your contribution to the price and from any lenders their loan funds. 

  • You must pay rent up until the settlement date.

 

After Settlement has taken Place
  • We will record the title in your favour along with any Security in favour of any lender. This process takes around 4-6 months.
  • After the deed has been recorded, if you have a mortgage, we will send the title deeds to your lender. Alternatively, we will make arrangements with you for their safe custody.
  • You are responsible for insuring the property. We can arrange insurance cover for you.
  • You are responsible for maintenance of your property, and for works which would previously have been carried out by the Council as Landlord. If you have a right to common parts you will be liable for a share of their upkeep.
